1. OUR COMMITMENT TO PRIVACY.

This Privacy Policy (“Privacy Policy”) sets forth Go For It Outdoor, LLC’s (the “Company”, “we” or “us”) policies regarding the collection and use of information provided through the Company’s website, [www.pavilionadventures.com] (the “Site”), and the Company’s related Pavilion™ mobile application (the “App” and collectively with the Site, the “Platform”). Please read our Privacy Policy carefully so that You (as hereafter defined) understand exactly what information we collect about You through the Platform, how we may use Your Personal Information (as hereinafter defined), the choices You have about how we use Your Personal Information, and how we protect that information.

By accessing the Site or downloading the App, You signify Your acceptance of the terms of this Privacy Policy. If You do not agree to the terms of this Privacy Policy, please do not use the Site or the App, uninstall the App and cease all other use of the Platform immediately.

This Privacy Policy addresses our privacy practices relating to use of the Platform by visitors to the Site, registered individual or organizational users of the Site and owners of the App (each, a “User”). For the purposes of this Privacy Policy, “You” or “Your” shall refer to you as a User.

It is Your responsibility to submit accurate information through the Platform. If You prefer that we not collect any Personal Information from You, please do not provide us with any such information. For purposes of this Privacy Policy, “Personal Information” is information which You provide to us which personally identifies You, such as Your name, email address or billing information, or other data which can be reasonably linked to such information. When You submit Personal Information and other information through the Platform, You hereby consent to the collection, use and disclosure of such information as set forth in this Privacy Policy.

2. THE INFORMATION WE COLLECT AND HOW WE COLLECT IT.

(a) Information You Provide.  Generally, You may use our Platform, including browsing the Site, without providing any Personal Information. However, we may ask that You provide information, including, without limitation, Personal Information, at various times and locations through the Platform. For example, if You decide to register, You will be asked to provide information such as Your name, user name, password, e-mail address, and You may have the option of adding a picture, address, and interests or other information. We may collect, use and store any Personal Information You enter through the Platform.

(b) Information Collected Automatically.  When You use the Platform, we store Your IP address and monitor Your activity. This information will not be stored in a manner that is personally identifiable with You. Also, in connection with Your use of the Platform, we may collect, use and disclose various categories of Non-Personally Identifiable Information. For purposes of this Privacy Policy, “Non-Personally Identifiable Information” means information that is recorded about Users so that it no longer reflects or references an individually identifiable User, for example, aggregated statistics generated from Users. Any such information disclosed to unrelated third parties will not contain Your Personal Information. If You use, or have used, the Platform to upload, post or store text, images, video or any other content (collectively, “User Content”) made while using the App or Site, we may synchronize Your existing and future User Content. We may also display Your User Content on the Site or App as dynamic geo-location data. When You use the Platform, we may use cookies and similar technologies like pixels and web beacons to collect information about how You use the Platform and provide features to You.  The Company or other third parties may also display ads or services to Your devices, which may use cookies or similar technologies placed by us or the third party.  If You register, we may also use cookies to store information such as Your email address, user name, preferences and password so we can identify You when You return to the Site and track Your use of the App or Site.  You may also set Your browser to block all cookies, including cookies associated with our Site.  However, it’s important to remember that some features of the Site may not function properly if Your cookies are disabled.

(c) Location Information. The Platform includes location-based features, such as mapping User Content. To provide these features, the Company may collect, use and share precise location data, including the real-time geographic location of Your mobile device. By using the Platform, and by uploading, posting or storing User Content through the Platform, You hereby acknowledge that such information may be viewed by other Users in combination with Personal Information such as Your username. If You do not wish to make this information publicly viewable, please access Your account settings to flag Your account as “private.”

(d) Information Collected by Third Parties. We may allow third parties to display advertisements through the Platform. The Company and such third parties may use tracking technologies to collect information about Users who view or interact with these advertisements and use the Platform. This information allows the Company and these third parties to deliver targeted advertisements and gauge their effectiveness. Some of these third party advertising companies may be advertising networks that are members of the Network Advertising Initiative, which offers a single location to opt-out of advertisements from member companies. We do not provide any Personal Information to these third parties without Your consent.

(e) Emails You Send to the Company. When You send an email to the Company, the Company may retain Your email address and the contents of the email You send. This Privacy Policy does not apply to content, business information, ideas, concepts or inventions that You send to the Company by email. Please refer to our Terms of Use for our policy with respect to such information. If You want to keep any information private or proprietary, please do not send such information in an email or otherwise post such information to the Company.

3. THE WAY WE USE INFORMATION.

(a) General Use of Information. We may use the information collected and provided through the Platform, individually or in an aggregate form, as follows:

(i) to contact You about the Platform;

(ii) to compare and otherwise use data entered by Users for any purpose including consulting, research and marketing;

(iii) to evaluate products and services the Company or third parties could offer to You;

(iv) to monitor or improve use of the Platform;

(v) to customize the advertising and content You see through the Platform;

(vi) to monitor compliance with the Company’s Terms of Use Agreement for the Platform;

(vii) to provide special offers to You from the Company and third parties; and

(viii) to send You promotional material on behalf of the Company and third parties.

(b) Public Areas. The Platform features profiles of registered individual and organizational Users (“User Profiles”), user data and lists, newsfeeds, and similar areas where Users may share information about themselves, their activities and their opinions, as well as post questions or comments on particular posts. These features are generally viewable by all Users (“Public Areas”). By using the Public Areas, You hereby acknowledge and agree that any information You share in a Public Area (including, without limitation, Personal Information) is available to the public. Information You post to a Public Area may be viewed, accessed, or collected by, or disclosed to, third parties and may be used by others in ways neither You nor the Company are able to control or predict, including, without limitation, to contact You for unauthorized purposes. Unless You flag Your account as “private,” Your User Profile, and all other User Content will be publicly viewable by other Users. If You do not wish to make this information publicly viewable, please access Your account settings to flag Your account as “private.”

(c) User Profiles. If You register to access more features of the Platform, the information You provide to the Company may be stored in one or more profiles. These User Profiles, including Your username, email address, home city, and optional information including a picture and interests, may be viewed by other Users.  If You do not wish to make the information in Your User Profile publicly viewable, please access Your account settings to flag Your account as “private.”

4. WITH WHOM WE SHARE YOUR INFORMATION.

Except as otherwise provided in this Privacy Policy, we will not give, share, sell, or trade Your Personal Information to or with any third parties in any way other than under the following circumstances:

(a) Affiliates. We may share Your Personal Information with our Affiliates (as hereafter defined), who may use Your information for purposes similar to the purposes for which we collect such information. For purposes of this Privacy Policy, “Affiliates” means the Company subsidiaries and companies the Company has a licensing or partnership arrangement with. We ask all Affiliates to comply with the terms of our Privacy Policy.

(b) Fulfillment of Services. We may retain other companies and individuals to perform functions consistent with our Privacy Policy on our behalf. Examples include customer support specialists, Web hosting companies, fulfillment companies (e.g., companies that fill product orders or coordinate mailings), data analysis firms and email service providers. Such third parties may be provided with access to Personal Information needed to perform their functions, but may not use such information for any other purpose.

(c) Compliance with Law and Fraud Protection. We may disclose any information, including, without limitation, Personal Information, we deem necessary, in our sole discretion, to comply with any applicable law, regulation, legal process or governmental request. We may also exchange information, including, without limitation, Personal Information, with other companies and organizations for risk reduction and related activities. The Company reserves the right to disclose personally identifiable information, including, without limitation, Personal Information, for a User who we believe is in violation of our Terms of Use, even without a subpoena, warrant, or other court order.

(d) Sale or Transfer of Information. In the event of a sale, merger, liquidation, dissolution, or sale or transfer of substantially all of the assets of the Company, Personal Information or other information collected about You from the Platform may be sold, assigned, or transferred to the party acquiring all or a substantial part of the equity or assets of the Company in order to permit the party to continue the operation of the Platform. Subject to Your ability to opt-out, by using the Platform and submitting Your information to us, You disclosed in this Privacy Policy above, we will not disclose Your Personal Information to third parties unless You have provided consent.

5. THIRD-PARTY LINKS.

We may provide links to third-party websites as a service to our Users. Please be aware that we cannot control and are not responsible for the information collection practices of such websites, which may differ from those of the Company. We encourage You to review and understand the privacy policies of these websites before providing any information to them.

6. YOUR RIGHTS, OUR OBLIGATIONS.

The Company respects the privacy of Your Personal Information. If You tell us that You do not wish to have this information used as a basis for further contact with You, we will respect Your wishes (except to the extent we need to communicate with You about closing Your account with us). You can also choose not to provide us with certain information, but that may result in Your being unable to use certain features of the Platform. You may instruct the Company to stop sending You certain promotional materials (e.g., e-mail messages, catalogues, postcards and letters) by following the unsubscribe instructions provided in those materials. However, we may continue to contact You to provide service to Your account. If You wish to opt-out of any continued communication (direct mail, telephone, fax or e-mail communications), please contact us at info@pavilionadventures.com. We will process an opt-out request as soon as reasonably practicable. If You choose to opt-out of further communications, we will keep Your e-mail address, phone number, name and physical address on file for the purpose of honoring Your opt-out request.

7. DATA SECURITY.

The Company maintains a variety of physical, electronic, and procedural safeguards designed to protect Your Personal Information from unauthorized access and disclosure. We take commercially reasonable precautions to protect the information You provide, including using accepted tools and techniques to protect against unauthorized access to our systems. You should be aware that the Company has no control over the security of other sites on the Internet You might visit or interact with even when a link may appear to said site from ours. We want You to feel confident using the Platform. However, no system can be completely secure. Therefore, although we take steps to secure Your information, we do not promise, and You should not expect, that Your Personal Information, searches, or other communications will always remain secure. In the event of a breach of the confidentiality or security of Your Personal Information, we will notify You as necessary so You can take appropriate protective steps. We may notify You under such circumstances using the e-mail address we have on record for You. Users should also take care with how they handle and disclose their Personal Information. Please refer to the Federal Trade Commission’s website at http://www.ftc.gov/bcp/menus/consumer/data.shtm for information about how to protect Yourself against identity theft.

8. OUR SERVICES ARE NOT FOR USE BY CHILDREN.

The Platform is a general audience services, and we do not knowingly market to, solicit information, or collect information from children under the age of 13. If a child under 13 submits information about themselves to us through our Platform, and we become aware that the person submitting the information is a child, we will attempt to delete this information as soon as possible. If You are under the age of 18, Your parent or legal guardian must agree to this Privacy Policy on Your behalf.

9. ACCESS: HOW CAN I REVIEW, UPDATE OR CORRECT MY INFORMATION?

If You would like to review, update or correct Your profile, please log in to Your account and select the profile You would like to review or modify.

10. CHANGES TO THIS PRIVACY POLICY.

We will occasionally update this Privacy Policy to reflect changes in our practices. When we post changes to this Privacy Policy, we will revise the Effective Date at the top of this Privacy Policy. If we make any material changes to our Privacy Policy, we will notify You by sending an e-mail to the e-mail address provided us in Your account, profile or registration or by prominently posting notice of the changes on the Site or through the Platform. We recommend that You check the Site from time to time to inform Yourself of any changes in this Privacy Policy or any of our other policies.

11. QUESTIONS ABOUT THIS PRIVACY POLICY.

If You have questions or concerns about this Privacy Policy or request that we not use Your Personal Information for a particular purpose, please contact us. We try to answer all inquiries within a reasonable time, but may not always be able to do so.

12. OTHER INFORMATION ABOUT OUR PRIVACY PRACTICES.

(a) California Residents. If You are a resident of California, in addition to the rights set forth in this Privacy Policy, You have the right to request information from us regarding the manner in which we share certain categories of Personal Information with third parties for their direct marketing purposes. You have the right to opt-out of sharing Your Personal Information for third party marketing purposes.

(b) Using Our Services from Outside the United States. Our Site is hosted in the United States. Our Services are governed by United States law. If You are using the Platform from outside the United States, please be aware that Your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in Your country. By using the Platform, You consent to Your information being transferred to our facilities and to the facilities of those third parties with whom we share it as described in this Privacy Policy.

(c) No Rights of Third Parties. This Privacy Policy does not create rights enforceable by third parties.
